Boston Car Accident Lawyer

Car Accident Lawyer Massachusetts

Every year in Massachusetts, there are thousands of car accidents reported, thousands of injuries, and hundreds of deaths. In fact, car accidents are so common that they are one of the leading causes of injury and death.

If you have been in a car accident, you may expect that the insurer will pay your claim, treat you fairly, and that you will walk away with the settlement that you deserve. Unfortunately, it doesn’t always work like this. Insurance companies are profit-driven, and claimants are often surprised when they are offered settlements that are far less than their losses – or their claim is outright denied.

At Brooks Law, we know how terrifying being involved in a car accident can be, and how it can affect your finances, family, and future. When you call our experienced Massachusetts car accident lawyers, you can count on us to advocate aggressively for you every step of the way.

How We Can Help Your Car Accident Claim

At Brooks Law, our dedicated car accident attorneys handle every aspect of your case, from insurance claims to pursuing full compensation, so you can focus on your recovery. We’re committed to achieving the best possible outcome for you while ensuring those responsible are held fully accountable.

    Our services include:

    • Free Consultation: Before you even hire our law firm, we want to sit down with you to discuss your accidents and your legal options. We perform this service free of charge. This is an opportunity for you to ask questions and learn more about the claims process and why working with our team is right for you.

    • Investigation: Once you decide to work with our law firm, we will start building your claim. The process kicks off with an accident investigation. This is where we start to collect evidence to build the various elements of a car accident claim, including fault and damages. During this process, we may hire experts who can help put together the pieces of what happened and how you were harmed.

    • Organization And Claim Building: Once we know what happened, who’s at fault, and what your damages are, we’ll start putting everything together in an organized manner in order to present your claim to the insurance company in a compelling fashion. We have a large staff and the resources it takes to execute this part of the process efficiently and effectively.
    • Negotiating For A Settlement: Our lawyers are skilled negotiators. If you are offered a settlement that we believe is lower than what you deserve, we advise you not to accept it. We will go back to the table to negotiate a higher offer. It’s important to us that you walk away with full compensation.

    • Litigating Your Case In Court: Our goal is to reach a settlement offer that both parties can agree on out of court. This is the often most cost-efficient and time-effective method of settling a claim. However, there are some situations where an insurer will not budge, and therefore pursuing a lawsuit may be the only remaining option. If going to court is necessary, we will handle all elements of this process on your behalf, including filing your lawsuit, deposing witnesses, filing all motions, and litigating your case.

If you need anything at all during the process, our lawyers will be here to serve you. An experienced car accident attorney can guide you through the many steps of presenting your case.

What Kind Of Compensation Can I Receive?

In a car accident claim that results in serious injuries and damages and was someone else’s fault, a claimant deserves to be fully compensated for the extent of harm that they have suffered. The amount of compensation that will be available in your car accident claim will be affected by factors such as:

    • Degree Of Fault: Massachusetts is a modified comparative negligence state. Massachusetts General Law Chapter 231 § 85. What this means is that you cannot recover any money for your injuries if a judge or jury finds you to be 51% or more at fault for the accident.  If you are found to have contributed less than 51% toward the accident, then you may recover money.  The amount of money, however, is reduced by the percentage of fault the judge or jury assigned to the plaintiff. This is why having a trustworthy and experienced attorney is important– they can advocate for your interests to argue that most if not all of the fault is on the other driver.
    • Personal Injury ProtectionMassachusetts is also a no-fault state, which means that after an accident, claimants must file a claim with their own insurance company first, regardless of fault for what is known as personal injury protection or “PIP” benefits. PIP will cover either $2,000 or $8,000 of your medical bills, regardless of fault, depending on the type of health insurance you have (either private or public). The benefit of PIP coverage is offset by what is known as the “PIP offset”, which allows the at-fault to offset or subtract the gross settlement figure from the PIP benefits paid to you. An experienced attorney is able to best give you the benefit of PIP coverage while being able to apply the correct offset to your settlement negotiations in the correct context.
    • Damages: Another factor that will have a large impact on your final compensation award is the amount of losses you have suffered. More serious accidents tend to result in more serious – and more costly – damages. If you are pursuing damages outside of the no-fault system, the type of damages for which you may seek compensation could include:

      • Past And Future Medical Costs
      • Lost Wages And Future Lost Wages
      • Loss Of Earning Capacity And Benefits
      • Pain And Suffering
      • Emotional Distress
      • Diminished Quality Of Life
      • Other Economic And Noneconomic Losses

    • Insurance Policies: Even if you have solid proof that the other party was 100 percent to blame for your accident, and even if your damages total in the tens of thousands of dollars or more, you will likely be unable to recover compensation if the at-fault party had no insurance or too little coverage. However, you may be able to turn to your own policy’s underinsured motorist coverage (UIM) in some cases. In cases where the at-fault party has no insurance at all, you may also be able to turn to your own policy’s uninsured motorist coverage (UM). Both UIM and UM coverage are mandatory in Massachusetts- so long as you maintained active auto insurance at the time of an accident occurring in Massachusetts, you can rest assured you are covered in the event the responsible party doesn’t have or doesn’t have enough insurance.

Is There A Time Limit For Filing A Car Accident
     Lawsuit In Massachusetts?

Massachusetts limits the amount of time that a party has to bring forth a lawsuit after an accident to three years from the date of the accident. If you exceed the three-year time limit, you can be permanently barred from recovery. For this reason, it is best to talk with a car accident attorney as soon as you are able to do so following your crash.

What To Do If You’ve Been Hurt In A Car Accident?

If you have been hurt in a car accident, it’s important that you take the following steps to avoid putting your right to recovery in jeopardy.

    • File A Police Report: You must file a police report after an accident in Massachusetts if the accident results in property damage in excess of $1,000 or if anyone is injured or killed. Not only is filing a police report important because doing so ensures that you are complying with the law, but it is also important because a police report can provide valuable information when you pursue a claim.

    • Collect Evidence At The Scene: If you are able to, while you wait for the police to arrive on scene, you should start collecting as much evidence and information as possible. This includes the names and contact information for any other parties involved, the specifics of any other vehicles involved, the names and contact information of any witnesses to the accident, photos of the accident, a sketch diagramming the vehicles’ positions following the accident, and any other details that could be important to the outcome of your claim.
    • Go To The Hospital Or See Your Doctor: If you do not go to the hospital or go to see your doctor after being involved in a car accident and then later file a claim for medical expenses and injury-related costs, you can be almost certain that the insurer will try to deny your claim. Not only should you see the doctor, but you should also keep detailed notes and records of these doctor’s appointments, and you should also follow your doctor’s instructions.
    • Notify Your Insurer: After you have filed a police report and seen a doctor, the next step is to call your insurer and provide them with notice of the accident. If you fail to give your insurer notice within a reasonable amount of time, it may maintain the right to deny your claim.
    • Call A Car Accident Lawyer: Even claims where injuries are not serious are often best navigated with legal counsel. If you have a complicated claim, the fault is uncertain, your injuries are serious, or your settlement has been low-balled, you absolutely need to call a lawyer as soon as possible. Brooks Law can help you navigate this important and critical moment in pursuing your car accident claim.

What Are Some Common Car Accident Injuries?

Injuries from a car accident can drastically alter a person’s life, leading to weeks or even months of pain, loss of income, and limitations, even if the injuries eventually heal. Some of the most common car accident injuries include:

    • Head and Brain Injuries: Traumatic brain injuries (TBIs) can have life-altering consequences, often requiring long-term care.

    • Spinal Cord Injuries: Devastating and often resulting in permanent paralysis, these injuries impact an individual for the rest of their life.

    • Facial Injuries: Common for front-seat occupants, these injuries can result from airbag deployment or impact with hard surfaces, leading to bruising or broken facial bones.

    • Soft Tissue Injuries: Damage to ligaments and muscles, particularly in the neck and back, such as whiplash, is common and can lead to chronic pain.

    • Broken Bones: Fractures in the ribs, face, or other body parts are frequent, sometimes leading to further complications like infections or organ punctures.

At Brooks Law, our attorneys leverage a vast network of treatment providers and specialists across all injury types to ensure comprehensive care. We work closely with medical experts who assist in connecting the dots for both simple and complex injuries, preventing insurance companies from downplaying your suffering. Our commitment is to secure the full compensation you deserve by fully understanding and presenting the impact of your injuries.

Who Is Responsible For Paying My Bills After A Car Accident?

Ultimately, the party or parties responsible for your car accident should be held accountable, but securing full compensation can take weeks, months, or even years. In the meantime, your personal injury protection (PIP) coverage or health insurance can help cover medical expenses, allowing you to focus on recovery without the stress of unpaid bills. By law, your PIP premiums won’t increase for using this coverage. At Brooks Law, we go the extra mile to ensure you’re fully supported during this process, taking the time to maximize your PIP benefits and manage any insurance liens, so you can concentrate on your physical recovery while we handle the financial complexities.

What Must I Prove To Hold Someone Responsible For My Car Accident Damages?

You will need to prove that the party acted either intentionally, recklessly, or negligently. To show that someone’s negligence caused your car accident, you will need to prove:

    • Duty – In car accident cases, this is typically straightforward as every motorist on the road owes a duty of care to others on the road.
    • Breach – The at-fault party, through their actions or omissions, breached that duty of care.
    • Causation – The responsible party’s breach of their duty directly and proximately caused injury to another person.
    • Damages – The injured person has incurred some compensable damages, such as medical expenses, lost wages, or pain and suffering.

At Brooks Law, our attorneys work tirelessly to gather strong, meaningful evidence to fully support your claim on all fronts, ensuring a compelling case that maximizes your chances of victory.

    Should I Settle My Claim?

When deciding whether to accept a settlement for your car accident claim, it’s crucial to ensure that the compensation you receive covers all your damages, both current and future. Once you settle, you can’t return to the insurance company or the at-fault party for more money if additional damages arise later. That’s why it’s typically wise to wait until you’ve reached “maximum medical improvement”—the point at which your doctor confirms that no further treatment will improve your condition—so you have a clear understanding of your total damages.

Unlike other firms that may rush to settle for less, at Brooks Law, we take the time to fight for the maximum compensation you deserve. Before accepting any settlement offer, have it reviewed by an experienced car accident attorney who can accurately assess your claim’s true value and ensure you’re getting a fair deal.

    How Can I Prove Fault?

You can prove fault in a car accident with the following evidence:

    • The crash report/formal police report
    • Photos of the accident scene
    • Photos of the at-fault driver
    • Photos of damage to the vehicles involved
    • Vehicle damage/repair reports
    • Eyewitness statements
    • Surveillance video from around the scene
    • Medical records of your injuries

In complex accidents, experts in accident reconstruction may use these pieces of evidence to create reports, animations, or re-creations that clearly demonstrate how the crash occurred and who was at fault.

At Brooks Law, our experienced attorneys are well-versed in the rules of the road and vehicle mechanics. We work closely with our network of accident reconstruction specialists, communicating with them in technical terms to produce compelling expert reports. This expertise helps us shift the burden of fault onto the responsible party, ensuring you can focus on your recovery without worrying about the insurance company trying to shift blame onto you.

    Stay Off Social Media

Avoid making social media posts or sharing photos and videos of yourself after a car accident. Insurance companies and defense attorneys often scrutinize the social media profiles of claimants, searching for anything that contradicts your allegations or testimony. Even a seemingly harmless post could be used to challenge the severity of your injuries and undermine your claim. These details can significantly impact your case, which is why at Brooks Law, we take a holistic approach to every client. Our dedicated team pays close attention to every aspect of your situation to ensure maximum results and protect your right to full compensation.

Do I Need A Car Accident Lawyer For My Car Crash?

You are not required to hire an attorney to file an insurance claim or a lawsuit after you’ve been injured in a car accident. However, having an attorney will help ensure that your rights and interests are protected. The insurance companies want to settle car accident claims for as little money as possible. Insurers may try to take advantage of an injured car accident victim who isn’t represented by an attorney. They may try to get the victim to make a statement against their interest. Or they may offer a quick cash settlement that won’t come close to covering the victim’s medical bills and other expenses.

When you have an attorney on your side, your lawyer will deal with the insurance adjusters on your behalf. Your attorney can also lead a thorough investigation of your accident and collaborate with expert witnesses to build your case. That way, you can keep your focus and energy on your recovery rather than your claim.

When Is The Best Time To Contact A Car Accident Lawyer?

You should speak to an experienced car accident attorney as soon as possible after your crash. There is a limited window to file a claim for compensation, and the sooner you contact an attorney, the more time they have to thoroughly investigate your accident and build a strong, compelling case on your behalf. At Brooks Law, we’ve been holding those responsible accountable and driving long-term recovery and positive change in our community for over 10 years, ensuring that our clients receive the justice and compensation they deserve.
