After ICE transferred her to a hospital—where she remained under armed guard—counsel filed multiple emergency motions and supporting affidavits in the U.S. District Court for the District of Massachusetts, ICE released the client pending further litigation, allowing the client to receive proper medical care outside of detention. However, the general contractor held policies in both states.
We successfully argued that Massachusetts was the proper venue, demonstrating that the employer was registered in MA, the employee resides in MA, and all medical treatment occurred in MA.
This was a critical win. Due to liability disputes, the client’s medical bills were accumulating without payment. As a result of this ruling, his medical expenses will now be covered, future treatment secured, and indemnity benefits continued.
